INDIA GETS ITS FIRST LOKPAL OR ANTI CORRUPTION OMBUDSMAN

He is retired Supreme court judge and his name was recommended by the selection committee headed by Prime Minister NARENDRA MODI

CRITERIA TO BECOME LOKPAL HEAD

1. either Chief Justice of India
2. or judge of Supreme Court
3. or eminent personality with impeccable integrity and outstanding ability and special knowledge of anti corruption policy, governance, management.

HISTORY :- The concept of anti- corruption authority is borrowed from SWEDEN. The term LOKPAL was coined by L.M. SINGHVI in 1963. LOKPAL BILLS were introduced several times in 1971, 1977, 1985, 1996, 1998, 2001, 2005 and 2008 without being passed. Finally in 2013 LOKPAL AND LOKAYUKTA ACTS was enacted.( public movement by ANNA HAZARE, KIRAN BEDI and ARVIND KEJRIWAL)

SALIENT FEATURES OF THE LOKPAL ACT 2013:-
1.
The Lokpal Act provides for setting of LOKPAL at the centre and LOKAYUKTA at the State- level.
2. Lokpal committee consist of chairperson and maximum of eight members of which 50% judicial members + 50% SC/ ST/OBCs, minorities & women.
3. Ambit of Lokpal :- all public servants (including PM)
4. Lokpal mandated state to appoint Lokayukta within one year of Act.
5. If any case of investigation agency( including CBI) will be referred to Lokpal, it is to have full power of   Super-intedence.
6. Selection by a panel of PM, LS speaker, Leader of opposition, CJI and eminent jurist appointed by President.

NEED OF THE HOUR

This body should act freely and fairly with full transparency and accountability against corruption.

It should be free from political interference and not act like a caged parrot.

It should function impartially and independently to prevent and curb the corruption that has become part and parcel of citizens’ life.


WAY FORWARD

India which ranks 78 on CORRUPTION PERCEPTION INDEX, really needs to have some check and balances against corruption.
From ADMINISTRATIVE REFORMS COMMISSION point of view :- It should not just remove corruption and injustice but also try to gain public trust in governance machinery.

From CITIZENS’ viewpoint :- It is right of citizens to have corruption free life. And if it somehow is present in part and parcel of life, they should have a say in raising voice against corruption.

From FORUM’S point of view :- it should act independently, freely, fairly with transparency and accountability. Also actions need to be taken against corruption. It should prevent and curb corruption and try to delivery justice speedily.

Already we have got lokpal so late, now the actions and implementations should not take a stretch. Having a law is important but implementing it effectively is most important.
